Welcome to the Kitschn'Swell Store website. Your use of this site is subject to the terms of use listed below. These terms also govern the sale of goods by Kitsch N' Swell on the site. These terms are important to both you and us because they create a legally binding agreement and they protect your rights as a valued customer and our rights as a merchant.

The Site is available only for your personal use, which is limited to viewing the Site, obtaining and downloading information from the Site, including merchandise, for your personal information, and purchasing merchandise.

When using the Site or when communicating with Kitsch'n Swell following your use of the Site, you agree that all communications with us will be electronic and that such communications will bind you to Kitsch'n Swell.

Please review the payment methods, shipping details, return and exchange policy and our privacy policy on personal information. All policies of the Site are incorporated into these Terms by reference; and apply to your access and use of the Sites (Facebook, Instagram, Youtube) and the purchase of merchandise on the Sites.

These Terms and the Site Policies together constitute an agreement between you and Kitsch'n Swell Inc. (a corporation incorporated under the laws of the Province of Quebec, having its head office at 4065 boul. St-Laurent, Montreal (Quebec), H2W 1Y7, Canada and doing business as Kitsch'n Swell) relating to your use of the Site, the purchase of goods and services, and any orders placed on the Site.

BY USING THESE SITES AND/OR PLACING ORDERS ON THE SITE, YOU ACCEPT THE TERMS AND POLICIES OF THE SITE AND AGREE TO BE BOUND BY THESE TERMS AND POLICIES OF THE SITE. IF YOU DO NOT AGREE WITH THESE TERMS OR POLICIES, PLEASE REFRAIN FROM PLACING ORDERS AND USING THE SERVICES PROVIDED ON THE SITE. IF YOU ARE DISSATISFIED WITH THESE TERMS OR WITH ANY OF THE POLICIES OR THE SITE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE KITSCH'N SWELL WEBSITE.

Kitsch'n Swell reserves the right to remove or edit any material or content on its site (including by terminating, changing, suspending or discontinuing any aspect of it) and the right to withdraw any goods from the site at any time. We will not be liable to you or any other person as a result of any such actions.

Viewing, printing and downloading any graphics, documents or other content from the Site grants you a limited, non-exclusive, non-transferable license for your personal use only and not for reproduction, distribution, assignment, sublicense, sale, preparation of derivative works or any other purpose. No part of any graphics, forms, documents or other content from the Site may be reproduced in any way or incorporated into a computer system. Any unauthorized use of the Site or its content will automatically terminate this license without notice.

You agree that:

  1. you may only use the Site to make legitimate inquiries and requests or place orders;
  2. you will not place speculative, false or fraudulent orders for goods. If we are of the opinion that such an order has been placed, we may cancel the order and notify the relevant authorities;
  3. you agree to provide us with a true and accurate email address, postal address and/or other contact information and you acknowledge that we may use this information to contact you if necessary. If you fail to provide us with all required information, we may experience difficulties in processing and delivering your order. Please review our Privacy and Security Policy regarding your personal information.
  4. you will not interfere with or attempt to interfere in any way with the network or network security, or attempt to use the Site to gain unauthorized access to any other computer system;
  5. you will not use the Sites to communicate, transmit, post commercial electronic messages or post content that infringes any third party's intellectual property rights, privacy rights or publicity rights;
  6. you will not use the Sites to conduct yourself in a manner that constitutes a civil or criminal offense, or otherwise violates any municipal, provincial, federal or international law;

We are delighted to hear from users of the Site and our social networks, and we welcome your feedback. Accordingly, as part of your use of the Site and the services offered, you may upload, display, distribute or share content and materials (including, but not limited to, photos you have taken, articles you have written, captions and comments) and we, at our sole discretion, may display them or allow you to display them through the Site or our Facebook page and/or our Instagram page.

You acknowledge and agree that you are solely responsible for the form, content, and accuracy of any Posted Content. You will not post false or inaccurate content, and you will not remove or revise content that was not posted by you. You are responsible for your own Posted Content, and you are responsible for the consequences of your Posted Content. You agree not to post:

  1. Any Content that (i) is subject to any copyright or trademark, (ii) is confidential or subject to any other right, (iii) reveals a trade secret, or (iv) infringes upon the intellectual property rights, privacy rights or publicity rights of any third party; in each case, unless you are the owner of the required rights or have obtained the owner's prior permission (including any required consents and waivers, as applicable) to post the Content;
  2. Any content that is unlawful, obscene, pornographic, sexual, indecent, defamatory, threatening, harassing, abusive or hateful to another user or any other person or entity;
  3. Any chain letter or pyramid scheme; or
  4. Any content that contains a virus, Trojan horse, worm, time bomb or other computer programming routine or engine designed to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information

The Website, including all information and content, such as text, data, background, icons, characters, art, images, animations, videos, photographs, graphics, messages, software and HTML used to generate the pages of the Site, are the property of Kitsch'n Swell, our suppliers or our licensors and are protected by patent, trademark and/or copyright rights in Canada, the United States and/or elsewhere.

The availability of merchandise displayed on the Sites may vary and merchandise displayed may be out of stock or discontinued. Some merchandise may be available only in limited quantities or while supplies last. When an item is out of stock, we will attempt to remove the item promptly from display on the Sites. The display of an item on the Sites is not a guarantee that the item is in stock or will be in stock at a later date.

Although we have made every effort to display accurate images of the goods on the Sites, the appearance of the products displayed will depend on the user's screen or device. We cannot guarantee that your screen or device will accurately display the colors, textures or other details of the products.

All prices are displayed in Canadian dollars.
